1. Acceptance of Terms

By accessing or using BatchWorks ("the Service"), operated by Jetworks AI ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

BatchWorks is a cloud-based platform for food manufacturers that provides production tracking, recipe management, inventory control, and third-party integrations. Access is provided on a subscription basis.

3. Accounts and Access

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Each user must have their own account. You agree to notify us immediately of any unauthorised access.

4. Subscriptions and Payment

Paid plans are billed monthly in advance. Pricing is based on the number of active users in your organisation. We reserve the right to adjust pricing with 30 days' notice. Refunds are handled on a case-by-case basis at our discretion.

5. Your Data

You retain ownership of all data you enter into BatchWorks. We do not claim any intellectual property rights over your content. We will not access your data except as necessary to provide the Service, respond to support requests, or comply with legal obligations.

6. Acceptable Use

You agree not to misuse the Service. This includes but is not limited to: attempting to gain unauthorised access to other accounts or systems, using the Service for unlawful purposes, or interfering with the operation of the platform.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, BatchWorks and Jetworks AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. You may cancel your subscription through the platform. We may suspend or terminate access if you violate these terms. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These terms are governed by the laws of Australia. Any disputes arising from these terms or the use of the Service shall be resolved in the courts of Western Australia.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the platform or email. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
